Introduction

These Terms and Conditions ("Agreement") govern your use of Hadhr services ("Services"), including the application, website, and labor marketplace. By accepting these terms, you agree to comply with all provisions and conditions contained herein.

If you are using the Service on behalf of a company or organization, you represent that you have the authority to accept these terms.

Definitions

For purposes of this Agreement:

Hadhr ("Company")

Refers to the attendance tracking platform and digital marketplace provided by Hadhr.

Worker ("User")

Any person using the application to clock in/out or search for job opportunities.

Employer ("Registered Company")

Any organization using Hadhr to track employee attendance.

Agent

Any intermediary who helps match workers with job opportunities for a commission.

Marketplace

The platform through which companies can search for workers and workers can showcase their services.

User Account

Registration and Accuracy

You are responsible for providing accurate and complete information upon registration. You must update your information if it changes. Using false or misleading information may result in account suspension.

Password Protection

You are responsible for keeping your password confidential. Sharing your password with others or third-party misuse of your account is not our responsibility.

Account Responsibility

You are responsible for all activities that occur under your account, whether you perform them or not.

Services Provided

Free Service

Hadhr provides a free attendance tracking service covering up to 50 employees and 1 project. This service is provided "as-is" without warranty.

Pro Plan

The paid plan (499 SAR monthly) includes 500 employees, unlimited projects, access to the labor marketplace, payroll, and exports.

Enterprise Plan

Available at custom pricing for large organizations with special requirements.

Labor Marketplace

Commissions and Taxes

Hadhr retains a 10% commission from the value of each contract in the marketplace. Value-added tax of 15% is applied to all contracts in accordance with Saudi law. Agents receive 1-2% of Hadhr's commission for each successful match.

Employment Agreements

All contracts entered into through the marketplace must comply with Saudi labor law and legal worker benefits. Hadhr is not a party to these contracts and presents itself as a mediation platform only.

Liability for Third Parties

Hadhr is not responsible for the conduct of any worker, employer, or agent in the marketplace. The parties agree to resolve any disputes between them directly.

User Obligations

You agree not to:

Falsify Records

Falsify attendance records or allow your employees to clock in on your behalf or based on false information.

Impersonation

Use another person's account or claim to be someone you are not.

Illegal Activity

Use the Service for any illegal purpose or in violation of Saudi law.

Harassment and Abuse

Harass or abuse any other user through the Service.

Intellectual Property Violation

Publish or distribute content owned by Hadhr or other users without permission.

Intellectual Property

All Hadhr content, including logos, icons, text, code, and designs, is owned by or licensed to Hadhr. You cannot copy, distribute, or modify any of this content without written permission from Hadhr.

The application and website are protected under Saudi intellectual property law and international agreements.

Disclaimer

Services As-Is

Services are provided "as-is" and "as available" without any warranty of any kind, whether express or implied.

No Warranty of Matches

Hadhr does not guarantee that marketplace matches will result in successful or satisfactory contracts for either party.

No Liability for Technical Errors

Hadhr is not responsible for any interruptions, technical errors, or service downtime.

Limitation of Liability

In no event shall Hadhr be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits or data, even if we have been informed of the possibility of such damages.

Our total liability does not exceed the amount paid by you to Hadhr in the previous month.

Governing Law and Jurisdiction

This Agreement is governed by the laws of the Kingdom of Saudi Arabia. Any dispute arising from this Agreement is subject to the exclusive jurisdiction of the courts in Riyadh.

Amendments to Terms

Hadhr reserves the right to modify these terms at any time. You will be notified of any material changes before they take effect. Your continued use of the Service after modifications means you accept them.

Termination

You can terminate your use of the Service at any time by deleting your account. Hadhr may also terminate the Service or suspend your account if you violate any of the terms of this Agreement.
