اتفاقية استخدام خدمات حضر
هذه الشروط والأحكام ("الاتفاقية") تحكم استخدامك لخدمات حضر ("الخدمات")، بما في ذلك التطبيق والموقع الإلكتروني وسوق العمالة. بقبولك هذه الشروط، أنت توافق على الالتزام بجميع الأحكام والشروط الواردة فيها.
إذا كنت تستخدم الخدمة نيابة عن شركة أو منظمة، فأنت تقر بأن لديك السلطة اللازمة للموافقة على هذه الشروط.
لأغراض هذه الاتفاقية:
تشير إلى نظام تتبع الحضور والسوق الرقمي المقدم من قبل حضر.
أي شخص يستخدم التطبيق لتسجيل حضوره أو إنشاء ملف عامل للتوفر في سوق عمالة المقاولات.
أي منظمة تستخدم حضر لتتبع حضور موظفيها.
أي وسيط يساعد على مطابقة عرض العمالة مع طلبات سوق المقاولات المعتمدة مقابل عمولة معلنة.
سوق حضر الذي تنشر فيه الشركات المسجلة طلبات عمالة المقاولات، ويقدم فيه الموردون أو العمال المؤهلون عروض التوفر.
أنت مسؤول عن توفير معلومات صحيحة وكاملة عند التسجيل. يجب عليك تحديث بياناتك إذا تغيرت. استخدام معلومات كاذبة أو مضللة قد يؤدي إلى إيقاف حسابك.
أنت مسؤول عن حفظ كلمة المرور الخاصة بك بسرية. نشرك لكلمة المرور مع الآخرين أو إساءة استخدام حسابك من قبل طرف ثالث ليس من مسؤوليتنا.
أنت مسؤول عن جميع الأنشطة التي تحدث تحت حسابك، سواء قمت بها بنفسك أم لا.
تشغيل الحضور الأساسي، ملفات العمال، المشاريع، نشر طلبات سوق العمالة، ومراجعة العروض مجانية حالياً أثناء مرحلة الإطلاق. لا توجد رسوم على العمال.
قد تضيف حضر لاحقاً عمولات نجاح، أدوات مميزة، تكاملات متقدمة، أو خدمات مدارة للشركات والموردين. أي رسوم مستقبلية يجب أن تظهر بوضوح قبل قبولها.
قد تتوفر خدمات مخصصة للشركات الكبرى أو التكاملات الخاصة بعد مراجعة النطاق والاتفاق المباشر.
نشر الطلبات ومراجعة العروض مجاني حالياً أثناء مرحلة الإطلاق. أي عمولة أو ضريبة أو ترتيب دفع مستقبلي يجب أن يظهر بوضوح قبل قبوله من الأطراف.
الاتفاق والدفع وتأكيد المتطلبات النظامية أو التشغيلية تتم مباشرة بين طالب العمالة ومقدم العرض حالياً. حضر توفر السجل التشغيلي وأدلة الحضور ولا تدعي اعتماد مستندات خارجية ما لم يتم تفعيل ذلك صراحة.
حضر ليست مسؤولة عن سلوك أي عامل أو صاحب عمل أو وكيل في السوق. الأطراف متفقة على أن تتولى حل أي نزاعات بينها بشكل مباشر.
توافق على عدم:
تزوير سجلات الحضور أو تسجيل الحضور نيابة عن شخص آخر أو بناءً على معلومات كاذبة. يمكن استخدام جهاز مشترك، لكن يجب أن تكون صورة السيلفي والموقع وسياق العملية حقيقية.
لا نعتبر نتيجة الوجه متحققة آلياً إلا عندما يعيد مزود مطابقة الوجه والحيّوية نتيجة ناجحة. ملكية الجهاز وحدها لا تثبت هوية العامل.
استخدام حساب شخص آخر أو ادعاء أنك شخص آخر.
استخدام الخدمة لأي غرض غير قانوني أو ينتهك القوانين السعودية.
التحرش بأي مستخدم آخر أو الإساءة إليه عبر الخدمة.
نشر أو توزيع محتوى تملكه حضر أو مستخدمون آخرون بدون إذن.
جميع محتويات حضر، بما في ذلك الشعار والأيقونات والنصوص والكود والتصاميم، مملوكة لحضر أو مرخصة لها. لا يمكنك نسخ أو توزيع أو تعديل أي من هذا المحتوى بدون إذن كتابي من حضر.
التطبيق والموقع محميان بموجب قانون الملكية الفكرية السعودي والاتفاقيات الدولية.
يتم توفير الخدمات "كما هي" و "كما تكون متاحة" بدون أي ضمان من أي نوع، سواء صريح أو ضمني.
حضر لا تضمن أن المطابقات في السوق ستؤدي إلى عقود ناجحة أو مرضية لأي من الطرفين.
حضر غير مسؤولة عن أي انقطاعات أو أخطاء تقنية أو توقف الخدمة.
في أي حال من الأحوال، لن تكون حضر مسؤولة عن أي أضرار غير مباشرة أو عرضية أو تبعية أو خاصة أو عقابية، بما في ذلك فقدان الأرباح أو البيانات، حتى لو تم إخبارنا بإمكانية حدوث هذه الأضرار.
مسؤوليتنا الإجمالية لا تتجاوز المبلغ المدفوع من قبلك لحضر خلال الشهر السابق.
تحكم هذه الاتفاقية القوانين المعمول بها في المملكة العربية السعودية. أي نزاع ينشأ عن هذه الاتفاقية يخضع للاختصاص الحصري للمحاكم في الرياض.
حضر تحتفظ بالحق في تعديل هذه الشروط في أي وقت. سيتم إخطارك بأي تغييرات جوهرية قبل سريانها. استمرارك في استخدام الخدمة بعد التعديلات يعني موافقتك عليها.
يمكنك إنهاء استخدام الخدمة في أي وقت بحذف حسابك. يمكن لحضر أيضاً إنهاء الخدمة أو إيقاف حسابك إذا انتهكت أي من شروط هذه الاتفاقية.

These Terms and Conditions ("Agreement") govern your use of Hadhr services ("Services"), including the application, website, and labor marketplace. By accepting these terms, you agree to comply with all provisions and conditions contained herein.
If you are using the Service on behalf of a company or organization, you represent that you have the authority to accept these terms.
For purposes of this Agreement:
Refers to the attendance tracking platform and digital marketplace provided by Hadhr.
Any person using the application to clock in/out or create a worker profile for construction labor-market availability.
Any organization using Hadhr to track employee attendance.
Any intermediary who helps match construction labor supply with approved marketplace requests for a commission.
The platform through which registered companies post construction labor requests and eligible suppliers or workers submit availability offers.
You are responsible for providing accurate and complete information upon registration. You must update your information if it changes. Using false or misleading information may result in account suspension.
You are responsible for keeping your password confidential. Sharing your password with others or third-party misuse of your account is not our responsibility.
You are responsible for all activities that occur under your account, whether you perform them or not.
Core attendance operations, worker profiles, projects, marketplace request posting, and offer review are currently free during the launch phase. Workers are not charged fees.
Hadhr may later add success fees, premium tools, advanced integrations, or managed services for companies and suppliers. Any future fee must be shown clearly before it is accepted.
Custom services may be available for large companies or special integrations after scope review and direct agreement.
Posting requests and reviewing offers are free during the current launch phase. Any future commission, tax, or payment arrangement must be shown clearly before the parties accept it.
Agreement, payment, and confirmation of legal or operational requirements are handled directly between the labor requester and the offer maker for now. Hadhr provides operational records and attendance evidence and does not claim to validate external documents unless that feature is explicitly activated.
Hadhr is not responsible for the conduct of any worker, employer, or agent in the marketplace. The parties agree to resolve any disputes between them directly.
You agree not to:
Falsify attendance records, clock in for another person, or record attendance based on false information. Shared devices are allowed, but the selfie, location, and action context must be truthful.
A face result is treated as automatically verified only when the active face and liveness provider returns a successful result. Device ownership alone does not prove worker identity.
Use another person's account or claim to be someone you are not.
Use the Service for any illegal purpose or in violation of Saudi law.
Harass or abuse any other user through the Service.
Publish or distribute content owned by Hadhr or other users without permission.
All Hadhr content, including logos, icons, text, code, and designs, is owned by or licensed to Hadhr. You cannot copy, distribute, or modify any of this content without written permission from Hadhr.
The application and website are protected under Saudi intellectual property law and international agreements.
Services are provided "as-is" and "as available" without any warranty of any kind, whether express or implied.
Hadhr does not guarantee that marketplace matches will result in successful or satisfactory contracts for either party.
Hadhr is not responsible for any interruptions, technical errors, or service downtime.
In no event shall Hadhr be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits or data, even if we have been informed of the possibility of such damages.
Our total liability does not exceed the amount paid by you to Hadhr in the previous month.
This Agreement is governed by the laws of the Kingdom of Saudi Arabia. Any dispute arising from this Agreement is subject to the exclusive jurisdiction of the courts in Riyadh.
Hadhr reserves the right to modify these terms at any time. You will be notified of any material changes before they take effect. Your continued use of the Service after modifications means you accept them.
You can terminate your use of the Service at any time by deleting your account. Hadhr may also terminate the Service or suspend your account if you violate any of the terms of this Agreement.

Sa paggamit ng Hadhr, sumasang-ayon kang magbigay ng tamang impormasyon, huwag gumawa ng pekeng pagdalo, at huwag gamitin ang account o pangalan ng ibang tao.
Libre sa yugto ng paglulunsad ang pangunahing pagdalo, talaan ng manggagawa, proyekto, kahilingan sa pamilihan ng manggagawa, at pagsusuri ng alok. Kung may bayad sa hinaharap, dapat malinaw itong ipakita bago tanggapin.
Pinapayagan ang pinagsasaluhang aparato, pero ang sariling larawan, lokasyon, at konteksto ng aksyon ay dapat totoo. Ang kasunduan sa pamilihan at bayad ay direkta muna sa pagitan ng mga panig.
